Terms of Service

TravelShield (Pty) Ltd ("we", "us", "our") provides a technology platform connecting individual Users to third-party armed response service providers ("Responders"). These Terms govern your use of the TravelShield App and our relationship with you.

By accessing the App, you agree to be bound by these Terms. We reserve the right to modify these Terms or change App features at any time.

These Terms constitute a binding contractual agreement between you and TravelShield. This agreement governs all aspects of your access to the App, its content, and the associated services provided through it.

The App provides a virtual panic button to request assistance from independent Responders. Services are restricted to specific geographic areas (e.g., Cape Town Central); it is your responsibility to verify coverage in your location.

You acknowledge that this service is a support tool for victims of crime and is not a preventative measure or a guarantee of safety.

You may not mirror, or use the App for any commercial purpose without our prior written consent, or otherwise incorporate any part of the TravelShield Service into any other application, website or service.

To ensure system availability, Users are urged not to overuse or abuse the App features. We can enforce a limit of usage or block you from the App should it get used for non-emergency use.

We advise a limit of 4 standard Responses per visit at the standard tariff. If you exceed this limit, we may refuse further responses or apply a surcharge of at least 10x the ordinary charge for additional activations.

By using the App, you indemnify TravelShield against any harm resulting from a refused response due to a breach of this policy.

Responders are independent contractors, not employees or agents of TravelShield. While we strive to ensure Responders are PSIRA compliant, we do not provide armed response services ourselves. We accept no liability for the acts, omissions, or response times of any Responder, nor do we guarantee that a Responder will accept your activation.

The provision of armed response services shall at all times be dependent upon the availability and proximity of Responders. By using the TravelShield App, you hereby acknowledge and agree that we have no control over whether a Responder accepts a panic activation or not and accordingly, we accept no liability and responsibility for their conduct in either accepting or declining a request for armed response received via the TravelShield App.

TravelShield grants you a limited, non-exclusive, non-transferable, and revocable license to use the App on your device for personal, non-commercial purposes only.

This service will only be available during your prebooked Time Blocks. You will have no access to the App before and after your visit to South Africa. All rights not expressly granted are reserved.

Fees for services are stipulated as per the pricing schedule indicated on the TravelShield website. The schedule can be changed at any time, as needed.

All prices are quoted, invoiced and charged in ZAR (South African Rand) at a daily rate and are inclusive of VAT where applicable. A USD display option is provided on the website for informational reference only and is an approximate conversion; it is not the currency of the transaction.

The TravelShield service will be charged only for the booked Time Blocks correlating to your visit/stay in South Africa as indicated on the payment portion of the Ecommerce platform. The App will be made active and available a day before your arrival and will be switched off the day after your departure. You will not be charged for the extra days.

When joining TravelShield Services, you will be prompted to register your details and make payment on the payment platform in ZAR. Where your issuing bank settles in a different currency, your bank may apply its own exchange rate and foreign-currency charges, which are not controlled by TravelShield.

TravelShield and its Responders are not liable for any failure to perform obligations caused by events beyond our control, including power outages ("load shedding"), network or server failures, strikes, acts of God, or government interference.

All content, logos, software (source and object code), and designs are the proprietary property of TravelShield or its licensors and are protected by South African and international intellectual property laws. Unauthorized reproduction or distribution is strictly prohibited.

Users must be at least 18 years old and provide accurate profile information. You are responsible for all activity on your account and must keep your password secure.

TravelShield is entitled to act on any instructions received via your account and is not liable for intercepted or distorted communications. The User agrees to and hereby indemnifies and holds TravelShield harmless against all and any claims, losses, costs, and expenses purporting to emanate from the User via the TravelShield Website.

While we aim for 24/7 functionality, we do not guarantee perpetual availability due to potential technical failures (connectivity, server issues, etc.). TravelShield is not liable for any losses resulting from system downtime and reserves the right to discontinue the service without notice.

User Accuracy: The user warrants that all instructions and information provided to TravelShield must be accurate and true.

No Service Warranties: TravelShield provides the app and services without any express or implied warranties. This includes no guarantees regarding the competence, qualification, or suitability of the independent Responders; the accuracy of website content or any third-party services provided through the app; or the effectiveness of security or encryption facilities.

Technical Disclaimers: TravelShield does not warrant that app functionality will be error-free or uninterrupted, nor that the app or its servers are free from viruses.

General Exclusion of Liability: TravelShield and its representatives are not responsible for any loss, damage (direct or indirect), or expenses arising from use of the app, reliance on its information, third-party services, or internet-related issues.

Nature of Service: Users explicitly acknowledge that the services are intended as a deterrent, not a preventative measure for criminal activity, and do not replace an insurance policy.

Responder Conduct: TravelShield is not liable for any acts or omissions — whether negligent or grossly negligent — committed by Responders or their staff. The user indemnifies TravelShield against any resulting damages.

If a court or arbitrator finds TravelShield legally liable, that liability is strictly limited to the lesser of:

• The total value of services the user paid for and utilised from their booked Time Block prior to the claim.
• R20,000.00

TravelShield accepts no responsibility for malfunctions in the app itself, the user's device, the responder's device, or any system integration issues.

You may terminate this agreement by sending written notice to TravelShield, deleting the App and deactivating your account.

TravelShield may suspend or terminate your access immediately if you breach these Terms or make unauthorised use of the TravelShield Service and/or the TravelShield App, or in other reasonable circumstances as determined by TravelShield at its discretion.

TravelShield has no obligation to provide ongoing maintenance or specific updates. By using the App, you consent to the collection of data as described in our Privacy Policy.

Any dispute arising from these Terms shall be settled by private arbitration in Johannesburg before a senior counsel. The arbitrator's decision will be final and binding. This clause remains in effect even after the termination of your account.

Users must exit the App after use to prevent unauthorised activations. TravelShield accepts no liability for unauthorised transactions or activations resulting from your failure to end a session.

These Terms are governed by the laws of the Republic of South Africa. They constitute the entire agreement between the parties. You may not cede your rights under this agreement without our written consent, though TravelShield may cede its rights to third parties at its discretion.
